CHECK FOR LOCAL
TELEPHONE NUMBERS
- By signing-up for N2Net Internet Access dial-up services, the
CUSTOMER agrees that the CUSTOMER is responsible for verifying that
the phone number the CUSTOMER is calling the Internet through N2Net
is a local access number for the CUSTOMER'S computer to dial. Any
telephone charges associated with CUSTOMER access to the Internet
through N2Net are solely the CUSTOMER'S responsibility. Please note
that N2Net does not reimburse or pay any telephone fees or long
distance fees or charges for any CUSTOMER for any reason.
N2Net strives to
provide fast and economical Internet access to you, our customer.
(CUSTOMER). Please review the following terms, policies and
conditions of N2Net (N2Net or N2Net Access). The terms, policies and
conditions will establish a binding contract (AGREEMENT) between the
CUSTOMER and N2Net. Explained in the terms, policies and conditions
are the obligations N2Net has to the CUSTOMER, and the CUSTOMER'S
obligations to N2Net when using N2Net Access for Internet access.
I.
Terms of Internet Access AGREEMENT
N2Net’s online
policies, and to agree that those policies are integrated into this
AGREEMENT by reference. Please take the time to read those
policies.
B.
Current account charges, including billing methods, rates and
surcharges for using N2Net Access are listed in N2Net’s online
policies or may be obtained by calling N2Net’s offices at
440-892-8833.
C.
CUSTOMER agrees that N2Net may revise the terms and
conditions of this AGREEMENT, revise its billing rates and account
surcharges, and revise the services provided under this AGREEMENT at
any time. These revisions will be binding and effective immediately
on posting the revised AGREEMENT on N2net’s home page or on
notification to the subscriber by e-mail or United States mail.
D.
The CUSTOMER will review the AGREEMENT periodically to be
aware of revisions. Upon review of the revisions in N2Net’s online
policies, the CUSTOMER has the opportunity to terminate this
AGREEMENT with N2Net by written notice via the United States mail.
Receipt of the CUSTOMER'S notice of termination by N2net will
activate the termination.
E.
The CUSTOMER'S use of N2Net Access after notice of revisions
in N2Net’s online policies will be proof that the CUSTOMER accepts
the revisions and agree to abide by the revisions.
F.
N2Net reserves the right to distribute informative e-mail to
subscribers that will enhance and improve N2Net's access service.
E-mails distributed to subscribers will be informative in nature and
provide notification describing changes, upgrades and other
important information involving the Internet medium.
II.
Registration Information
A.
The CUSTOMER agrees to provide accurate, complete and updated
registration information to N2Net. Failure to provide accurate
registration information results in the CUSTOMER'S unauthorized use
of N2Net Access and the CUSTOMER'S account may be terminated.
B.
Use of N2Net Access indicates that the CUSTOMER represents
themselves as being at least eighteen years old and are legally able
to enter into this AGREEMENT.
III.
N2Net Access Services
A.
N2Net will provide the CUSTOMER with unlimited connectivity
to the Internet through N2Net Access; no set up fees, no
cancellation fees; free customer technical phone support; fully
licensed Internet access software and/or instructions for software
configuration; and PPP Analog Internet access.
B.
N2Net or its affiliates do not own, operate, manage or in any
other way is affiliated with the Internet. The Internet is an
international computer network of both the Federal and non-Federal
inter-operable packet switched data networks. N2net cannot and will
not guarantee that the access it provides to the Internet is
sufficient to meet the CUSTOMER'S needs. The CUSTOMER agrees that
their use of N2net Access and the Internet is at the CUSTOMER'S own
risk and is subject to all local, state, national and international
laws and regulations.
C.
The CUSTOMER agrees that N2Net has the right, but not the
obligation, to restrict or terminate the CUSTOMER'S access to the
Internet at any time, if N2Net determines that the CUSTOMER is in
violation of this AGREEMENT. The CUSTOMER agrees that if N2Net
determines that the CUSTOMER is in violation of this AGREEMENT, any
restriction or termination will be effective immediately and without
prior notification. CUSTOMERS agree that N2Net will have no
liability to the CUSTOMER for any restriction or termination of the
CUSTOMER'S Internet access pursuant to such violation.
D.
The CUSTOMER agrees that if N2Net terminates the CUSTOMER'S
Internet Access services as a result of the the CUSTOMER'S policy
violations, N2Net has the right to deny refunds of any prepaid
account charges, and that this is forfeiture agreed to by the
CUSTOMER and N2Net. This forfeiture is not a penalty charge but is
considered liquidation damages.
E.
The CUSTOMER agrees that the CUSTOMER is responsible for
verifying that the phone number the CUSTOMER is calling the Internet
through N2Net is a local access number for the CUSTOMER'S computer
to dial. Any telephone charges associated with CUSTOMER access to
the Internet through N2Net are solely the CUSTOMER'S
responsibility. Please note that N2Net does not reimburse or pay
any telephone fees or long distance fees or charges for any CUSTOMER
for any reason.
IV.
Acceptable
Use
N2Net Access
provides the CUSTOMER access (through the Internet) to information,
communications, software, photos, video, graphics, music, sounds and
other material and services located on the N2Net servers and on the
Internet. This will be referred to as “content”.
A.
The CUSTOMER agrees that the CUSTOMER must evaluate and bear
the risks associated with the subject matter, accuracy, and
completeness of usefulness of any content available to the CUSTOMER
on or through N2Net Access.
B.
The CUSTOMER agrees that N2Net has the right, but not the
obligation, to remove content from the N2Net servers that N2Net, in
its sole discretion, determines to be in violation of this AGREEMENT
and N2Net’s online policies.
C.
The CUSTOMER agrees that N2Net has the right to remove any
content from its servers that it considers obscene, threatening,
harassing, libelous, or in any way a violation of intellectual
property laws. The CUSTOMER agrees that any material that
would be considered “indecent” or “appealing to the prurient
interest”, also commonly referred to as “adult material” is strictly
prohibited.
D.
N2Net also prohibits the transmission of unsolicited e-mail,
commonly referred to as “SPAM”. All mailing lists and use of List
Server are for “opt-in” purposes only. Each address on a mailing
list must result from a request to be on the list by the addressee.
E.
N2Net does not make a policy of pre-screening content placed
on its servers by its subscribers. N2Net does not have the ability
to monitor, review, or restrict prior to its transmission; content
that may violate this AGREEMENT or N2Net’s online policies.
Therefore, the CUSTOMER agrees that N2Net can not guarantee the
prompt editing or removal from its servers, any content that may
violate this AGREEMENT or N2Net’s online policies.
F.
N2Net Access provides access to the Internet, which provides
access to individuals who are not N2Net subscribers. The CUSTOMER
agrees that N2Net can not monitor, review or restrict any content
made available by third parties on the Internet, nor to edit or
remove any such content after its posting on the Internet. The
CUSTOMER also agrees that despite N2Net’s efforts, the CUSTOMER may
receive content, which the CUSTOMER may consider to be inaccurate,
defamatory, or otherwise offensive.
G.
The CUSTOMER agrees that N2Net shall have no liability for
the services, data or information made available to the public
through N2Net Access to the Internet; including any liability for
any consequential, indirect, special or incidental damages
regardless of the success or effectiveness of other remedies; the
CUSTOMER agrees that N2Net will not be liable for any action or
inaction with respect to any content posted on or through N2Net
Access and the Internet.
V.
Copyright
and Other Rights
A.
N2Net Access provides access to content that is protected by
copyrights, trademarks, intellectual property rights, and other
proprietary rights (“rights”) of independent third parties who make
such content available on or the N2Net Access service.
B.
The CUSTOMER agrees that when CUSTOMERS use such content, its
use will be governed by all applicable laws and regulations and by
specific restrictions placed on such content by the owners or
licensers of the rights of such content.
C.
The CUSTOMER agrees not to post or transmit content that is
subject to another party’s rights on or through N2Net Access without
that party’s express permission. Such posting or transmitting will
result in termination of this AGREEMENT and may result in civil or
criminal liability.
D.
The CUSTOMER agrees to obtain expressed authorization to
distribute content on or through N2Net Access by the holder of such
rights before the CUSTOMER uploads to software files, message boards
or any other content that is subject to any rights.
E.
The CUSTOMER agrees that by posting or transmitting content
to any public area such as public chat rooms, message boards, news
groups, web space or software libraries, the CUSTOMER is requesting
N2Net to make that material available to other Internet users. The
result of making this material available to other Internet users
will be that copies of CUSTOMER'S content is transmitted to others.
In order for N2Net to publish the CUSTOMER'S material, the CUSTOMER
automatically grants , or represents that the owner of the material
authorizes the CUSTOMER to grant, royalty free, perpetual,
irrevocable, non-exclusive right and license to reproduce, publish,
distribute, perform and display such material (partially or in its
entirety) worldwide to service the CUSTOMER'S request.
VI.
N2Net
Access Software
A.
CUSTOMER use of N2Net Access gives the CUSTOMER limited
rights to use the software through which the CUSTOMER accesses N2Net
and the Internet (“N2Net Access Software”). N2Net grants the
CUSTOMER a non-exclusive, non-transferable, revocable, limited
sub-license to use N2Net Access Software for connecting to N2Net
Access in accordance with this AGREEMENT.
B.
The CUSTOMER agrees that CUSTOMER use of N2Net Access
Software provides the CUSTOMER access to proprietary features of
N2Net and of software provided by N2Net’s licensers.
C.
N2Net and its software licensers have rights in N2Net Access
including but not limited to software, software documentation, the
“look and feel” of N2Net Access, N2Net Access names, subscriber
interfaces and other features.
D.
The CUSTOMER agrees not to copy, modify, adapt, reproduce,
translate, distribute, reverse engineer, de-compile, or disassemble
any aspect of N2Net Access’ that is owned by N2Net or its licensers.
VII.
No Warranty
A.
The CUSTOMER agrees that CUSTOMER use of N2Net Access, N2Net
Access Software and the Internet is solely at the CUSTOMER'S own
risk.
B.
The CUSTOMER agrees that N2Net Access and N2Net Access
Software is provided “as is”, “as available” basis without
warranties of any kind, either expressed or implied, unless such
warranties are legally incapable of exclusion.
C.
N2Net disclaims any and all loss of liability resulting from,
but not limited to
1.
loss of data
2.
loss of software or hardware
3.
loss of liability resulting from access delays or access
interruptions
4.
loss or liability resulting from computer viruses that travel
over the Internet
5.
loss or liability resulting from data non-delivery or data
miss-delivery
6.
any other loss or liability resulting from the negligent acts
and/or omissions of N2Net or N2Net’s subscribers.
7.
loss or liability resulting from any errors, omissions, or
misstatement in any and all information, goods, or services
obtained on or through N2Net Access
8.
loss or liability resulting from acts of God.
D.
The CUSTOMER agrees that N2Net’s entire liability, and the
CUSTOMER'S exclusive and all inclusive remedy with respect with the
CUSTOMER'S use of N2Net Access and N2Net Access Software, and any
breach of the AGREEMENT, is solely and irrevocable limited to the
amount the CUSTOMER paid to use N2Net Access services. In states
where liability for consequential or incidental damages is not
allowed, N2Net’s liability is limited to the extent permitted by
law.
VIII.
Indemnification
A.
The CUSTOMER agrees to defend, release, indemnify, and hold
N2Net, its affiliated companies and licensers, harmless, from all
liabilities, claims and expenses, including without limitation
reasonable attorney’s fees, arising from breach of the AGREEMENT, by
use of or in connection with, the posting or transmission of any
content by or through the CUSTOMER'S account with N2Net.
B.
The CUSTOMER agrees that N2Net has the right, but not the
obligation, at its own expense, to assume the exclusive defense and
control of any matter otherwise subject to indemnification by the
CUSTOMER pursuant to Paragraph A of this section. In such event,
the CUSTOMER shall have no further obligations pursuant to Paragraph
A of this section.
IX.
Cancellation
A.
The CUSTOMER agrees that the CUSTOMER or N2Net may cancel
this AGREEMENT for any reason at any time.
B.
The CUSTOMER agrees that the CUSTOMER'S only right, with
respect to dissatisfaction with: any AGREEMENT term; policy, or
N2Net practice of operation; content on or available through N2Net
Access or change therein; amount or type of fees or billing method
or changes therein; is to cancel this AGREEMENT as described in
Paragraph A.
C.
The CUSTOMER agrees that N2Net has the right, but not the
obligation, to delete all program, data, or other files on N2Net’s
servers that are associated with CUSTOMER'S account at the time of
cancellation.
D.
The CUSTOMER agrees that only the person whose name is on the
account will be able to
1.
change user ID and/or Password
2.
cancel an existing account
E.
The CUSTOMER agrees that some restrictions may apply to
selection of user ID.
F.
The CUSTOMER agrees that the following are non-refundable:
1.
Web and Publishing/Development fees
2.
Domain registration fees
3.
Static IP charges
4.
Shipping and handling charges where applicable
X.
Law
A.
This AGREEMENT constitutes the entire AGREEMENT between the
CUSTOMER and N2Net. The CUSTOMER agrees that this AGREEMENT
supersedes all prior understandings or AGREEMENTS whether oral or
written. This AGREEMENT may be modified only by a written
instrument and signed by both parties.
B.
The terms of this AGREEMENT shall be construed and enforced
under the laws of the State of Ohio.
N2Net Online
Policies
N2Net, Inc’s
mission is to provide complete Internet Solutions to its customers.
N2Net Access, the dial-up and hosting division of N2Net strives to
provide fast and economical access to the Internet while supporting
its customers with helpful technical support. In addition to these
services, N2Net Access strives to create worry-free and positive
Internet experiences by making every effort to reduce interference
by persons who use N2Net Access in an improper or unlawful manner.
N2Net Access
Online Policies include information regarding improper online
behavior. These policies include:

Billing
·
Content of online material that is found on the Internet through
N2Net Access
·
Purchasing goods from the Internet through N2Net Access
·
Complaint Procedures
N2Net Access’
Online Policies are part of the CUSTOMER'S subscriber AGREEMENT.
The CUSTOMER'S account is subject to suspension or cancellation if,
at any time the CUSTOMER restricts or inhibits other CUSTOMER'S use
of N2Net access by engaging in any or the activities prohibited by
N2Net.
All applicable
laws and regulations, and international laws and regulations govern
N2Net Access including all applicable local, state, national, other
applicable laws include laws relating to copyright, trademark,
obscenity, defamation, the right of privacy, false advertising, and
fraud.
N2Net also
requires that while using its services, CUSTOMERS must not interfere
with other CUSTOMER"S use and enjoyment of N2Net Access services.
The rules of proper Internet conduct govern all subscriber usage of
N2Net access to the Internet. N2Net requests that all CUSTOMERS use
their best judgment to be respectful of other CUSTOMERS' rights.
Please take the
time to review N2Net’s online policies. The prohibitive activities
listed do not represent proper Internet conduct and will be the
cause for immediate cancellation of the CUSTOMER'S N2Net dial-up
account.
I. Prohibitive
and Abusive Activities
Please note that
the term “material” means any information capable of being posted or
transmitted on or through N2Net Access, including print, graphic,
pictorial or audio form. Any abusive activities will be cause for
immediate cancellation of the CUSTOMER'S N2Net Access account and
services.
As a N2Net Access
subscriber, the CUSTOMER agrees not to participate in the following
activities:
1.
Defamation - the CUSTOMER agrees not to post or transmit any
information in violation of any applicable law.
2.
Fraud – the CUSTOMER agrees not to post or transmit any
fraudulent material on or through N2Net Access. This means any
material or information that the CUSTOMER knows or has reason to
know is false, and that the CUSTOMER intends others to rely on.
3.
False Advertising – the CUSTOMER agrees not to post or
transmit on or through N2Net any advertising or promotional
materials that contain false, deceptive or misleading statements,
claims or representations.
4.
Unsolicited Advertising – the CUSTOMER agrees not to post or
transmit any unsolicited advertising, promotional materials, or
other forms of solicitation to other subscribers, individuals, or
entities except in those areas (e.g., the classified areas, if
applicable) that are disunited for such a purpose.
5.
Copyright Violations – the CUSTOMER agrees not to post or
transmit on or through N2Net Access any information or material that
infringes on another person’s entity or copyright in all or any part
of the material.
6.
Trademark, Service Mark, and Trade Dress Violations – the
CUSTOMER agrees not to post or transmit on or through N2Net Access
any material or information that infringes another person’s rights
in its trademark, trade dress or service mark.
7.
Trade Secret Violations – the CUSTOMER agrees not to post or
transmit on or through N2Net Access any information or material that
reveals trade secrets belonging to another person, business, service
other entity.
8.
Obscenity – the CUSTOMER agrees not to post or transmit any
obscene or sexually explicit images or other content on or through
N2Net Access.
9.
Harassment, Threats and Abuse – the CUSTOMER agrees not to
use the Access Service to harass, threaten, abuse, embarrass or
cause distress, unwanted attention or discomfort to any person or
entity by any means, including the use of vulgar, hateful, racially,
ethnically or otherwise objectionable information or material.
10.
False Pretense – the CUSTOMER agrees not to use N2Net Access
to impersonate any person, including but not limited to, a N2Net
Access official or an information provider, guide, or host, or
communicate under a false name or a name that the CUSTOMER is not
entitled or authorized to use in all forms of online communication,
including, but not limited to, screen names, subscriber profiles,
chat dialogue and message postings.
11.
Chain Letters – the CUSTOMER agrees not to post or transmit
chain letters or letters or messages that offer a product or service
based on the structure of a chain letter, on or through N2Net
Access.
12.
Inappropriate Content – the CUSTOMER agrees not to post or
transmit on or through N2Net Access information or material that is
patently inappropriate material, e.g. information or topics not
related to the topics focused on by the participants in a particular
news group or mailing list. That would include material that is
obscene, threatening, harassing, libelous. The CUSTOMER agrees that
any material which would commonly be considered “indecent” or
“appealing to the prurient interest”, also commonly referred to as
“adult” material, is strictly prohibited.
13.
Scrolling – the CUSTOMER agrees not to cause the screen to
“scroll” faster than other customers or users are able to type to
it, or any action to a similar disruptive effect on or through N2Net
Access.
14.
Disruptive Activities – the CUSTOMER agrees not to use N2Net
Access to disrupt the normal flow of online dialogue or otherwise
act in a manner that negatively affects other subscribers, users,
individuals or entities.
15.
Violation of Service Provider’s Rules – the CUSTOMER agrees
not to use N2Net Access to violate any operating rule, policy, or
guideline of any other online service provider or interactive
service.
16.
Multiple Access – the CUSTOMER agrees that this AGREEMENT is
not transferable. The CUSTOMER agrees not to simultaneously access
N2Net Access for more than one session at any time.
17.
Abuse of N2Net Access’ Procedures – the CUSTOMER agrees not
to make false or unverified complaints against any N2Net subscriber
or otherwise abuse any of N2Nets Access’ complaint response
procedures.
18.
Systems Abuse – the CUSTOMER agrees not to abuse N2Net
Access’ system by causing any harm to the system so that it inhibits
other user’s ability to effectively use the system.
19.
SPAM – the CUSTOMER agrees not to post or cross post,
regardless of content, of the same message to twenty (20) or more
newsgroups or e-mail addresses. Any violations of our SPAM policy
will result in immediate cancellation of the CUSTOMER'S account.
II.
Content of Online Material
NOTICE: N2Net
Access provides access to information, communications, software,
photos, video, graphics, music, sounds and other material and
services located both on N2Net’s servers and on the Internet
(“content”). Please be aware that the Internet contains content,
goods and services that some CUSTOMERS may find improper, obscene or
otherwise offensive. Such content may not be appropriate for
CUSTOMERS or for any minors who may be accessing the Internet
through the CUSTOMER'S account.
As a matter of
policy, N2Net Access does not prescreen content placed on N2Net’s
servers by any of its subscribers and CUSTOMERS. N2Net does not
have the practical ability to monitor, review or restrict
information or material prior to its transmission. N2Net can not
ensure that content on N2Net’s servers that may violate N2Net
Access’ rules can be removed or edited before it is posted on
N2Net’s servers. The CUSTOMER may therefore receive offensive and
unsolicited information or material that N2Net can not control.
N2Net Access
retains the right to remove information or material from N2Net’s
servers that is in violation with N2Net’s CUSTOMER'S AGREEMENT.
However, N2Net Access provides access to users who are not part of
N2Net. N2Net Access does not have the ability to monitor, review or
restrict any content made available by third parties on the
Internet, nor edit or remove any such information or material after
its posting on the Internet.
N2Net can not be
responsible for any improper conduct, information or material and
services available on or trough N2Net Access. N2Net strongly
suggests that concerned parents consider using one of the
commercially available programs capable of restricting access to
sexually explicit material on the Internet. However, no parental
control software is 100% effective and CUSTOMER'S use of such
software is at CUSTOMER'S own risk. N2Net makes no suggestions or
warranties or representations as to the accuracy, completeness or
usefulness of any parental control software or service.
III.
Privacy of Communications
N2Net intends to
respect its CUSTOMER'S privacy and will not monitor or disclose the
contents of private e-mail or private chat room communications.
However, the CUSTOMER agrees that N2Net has the right, but not the
obligation, to monitor or disclose the contents of private
communication, if N2Net reasonable believes that such action is
necessary. The following will give N2Net reason to monitor or
disclose the contents of private communications:

to
comply with applicable law or valid legal process;
·
to
protect N2Net's rights or property;
·
in
emergencies when a person's physical safety is at issue.
IV. Online
Goods and Services
N2Net does not
control, provide, operate or take responsibility for any content,
goods or services available on or through N2Net Access. The
CUSTOMER may receive blind advertisements, pyramid schemes and other
schemes to get rich or make money, on or through N2Net Access.
These should be avoided or approached with skepticism and good
judgment.
All such content,
goods or services, are made available by independent third parties
and are not part of N2Net Inc. or N2Net Access. Please remember
that N2Net does not endorse, warrant or guarantee the accuracy,
completeness, usefulness, quality or availability of any content,
goods or services that are available to the CUSTOMER through use of
N2Net Access. The CUSTOMER'S use of material and information
provided on the Internet is solely at the CUSTOMER'S own risk.
N2Net will not be
party to or responsible for any product purchased by the CUSTOMER
through N2Net Access to the Internet. The CUSTOMER must use their
best judgment and use caution when purchasing a product over the
Internet through N2Net. N2Net assumes no responsibility for any
transactions between the CUSTOMER and any other persons providing
content, goods or services on or through N2Net. N2Net disclaims any
responsibility for any such transactions even where N2Net Access
features or displays a link with a particular World Wide Web site.
By using N2Net
Access, the CUSTOMER agrees that neither N2Net nor its affiliates,
shall be held responsible or liable, directly or indirectly, for any
loss or liability of any nature, or for damage caused or alleged to
have been caused, by the CUSTOMER'S use of or reliance on, any
content, material or information, goods or services available on or
through N2Net Access.
V. Account
Charges
The CUSTOMER'S
monthly account charges are payable in advance. No cancellation
fees will be applied. Upon notification of CUSTOMER account
cancellation from the CUSTOMER, N2Net will terminate service
effective as of the last day of the current billing cycle. Refunds
will be made on prepaid services that extend beyond the last day of
the current billing cycle. Prorated refunds will not be made.
If N2Net
terminates the CUSTOMER'S account due to violations of N2Net online
policies, service will be terminated immediately and the CUSTOMER
will forfeit any refund as liquidated damages, not as a penalty.
The CUSTOMER is
responsible for all activities and charges associated with the
CUSTOMER'S account. If any unauthorized charges are made on or
through the Customer's account, the CUSTOMER is responsible for the
charges until the CUSTOMER notifies N2Net of a breach of security by
calling N2Net at 440-892-8833 or 1-888-626-3828. The CUSTOMER will
need to change the CUSTOMER'S password at this time. Please be
advised that the contact person or owner of the N2Net Access account
is solely responsible for activities conducted through, on or with
their N2Net Access account. If the CUSTOMER or anyone to whom the
CUSTOMER has given access to the CUSTOMER'S account violates the
N2Net Access AGREEMENT, the CUSTOMER'S account will be canceled.
If the CUSTOMER
pays for their CUSTOMER account by credit card, the CUSTOMER
expressly authorizes N2Net to charge the credit card account number
associated with the CUSTOMER'S account for any N2Net Access service
charges that accrue from month to month. The CUSTOMER re-authorizes
N2Net to charge the CUSTOMER'S designated credit card account each
time the CUSTOMER uses N2Net Access services. This authorization
remains valid until the CUSTOMER terminates the CUSTOMER'S
authorization in writing. N2Net may immediately terminate the
CUSTOMER'S account, in N2Net's sole discretion, for declined credit
cards, returned checks, or any other non-payment of account charges.
A billing cycle
will begin on the date the CUSTOMER purchases N2Net Access service
and will continue for one month from that date. A new billing cycle
will begin on the anniversary date of the day of the month on which
the CUSTOMER purchased N2Net Access.
If the CUSTOMER
pays in a method other than credit card, the CUSTOMER'S account
charges are due the first day of CUSTOMER'S billing cycle.
The CUSTOMER'S account will be considered to be in default if
payment of the CUSTOME'S account charges are not received on or
before this date. If payment is not received by the closing of the
following business day after the CUSTOMER'S billing cycle begins,
the CUSTOMER'S account may be interrupted or terminated.
If any instrument
received for payment is returned to N2Net unpaid, the CUSTOMER'S
account will be considered to be in default, and in addition to the
amount due, the CUSTOMER will be subject to a returned check charge
of $25 which will be billed to the CUSTOMER account. If the
CUSTOMER account is interrupted or terminated for non-payment, the
CUSTOMER must continue to pay CUSTOMER'S monthly account charges due
to N2Net.
Only the
CUSTOMER'S signed written request to terminate CUSTOMER'S account
sent via regular U.S. mail will relieve the CUSTOMER of the
CUSTOMER'S obligation to pay the CUSTOMER'S monthly account
charges. All requests for account termination are to be sent to:

If the CUSTOMER'S
account is in default, the CUSTOMER is subject to an interest charge
of 2 percent per month, or the amount maximum allowable rate under
state law. If the CUSTOMER defaults on the CUSTOMER account, the
CUSTOMER agrees to pay N2Net its reasonable expenses, including
attorney's fees and collection agency fees, incurred in enforcing
N2Net's rights under N2Net Access' AGREEMENT.

Complaint Procedures
N2Net is committed
to customer service. That commitment means that N2Net is serious
about its responses to complaints about its CUSTOMER'S use of the
Internet. N2Net believes that its customers should be able to enjoy
full use of the Internet without interference by persons who use the
Internet (both N2Net subscribers and other users) in an improper or
unlawful manner.
N2Net will respond
to any complaints that involve online activities that are prohibited
activities under the N2Net Access AGREEMENT or online policies.
